1. Acceptance of terms
By accessing or using Saguaro List ("the Service"), you agree to these Terms & Conditions. If you do not agree, please do not use the Service.
2. About the Service
Saguaro List is an Arizona business directory, lead-generation platform, and product marketplace (the "Saguaro Store") operated by Bang AutoGlass LLC ("we", "us"). We help consumers discover local businesses, and help businesses get found, win customers, and sell their products.
3. Using the Service
You must be at least 18 years old to create an account. You are responsible for the accuracy of information you provide and for all activity under your account. Keep your login credentials secure.
4. Business listings
Listings may include publicly available business information. We do not guarantee the accuracy, completeness, or availability of any listing. Business owners may claim and manage their listing once ownership is verified. We may edit, suspend, or remove any listing at our discretion.
5. Paid plans & billing
Paid plans (Plus and Premium) are billed monthly in advance through our payment processor, Stripe, and renew automatically until canceled. You authorize recurring charges to your payment method. You can cancel at any time; cancellation stops future renewals. Fees already paid are non-refundable except where required by law. Applicable taxes are your responsibility unless we state otherwise.
6. Leads & communications
The Service may facilitate contact between consumers and businesses. We are not a party to, and are not responsible for, any transaction, agreement, or dispute between users and listed businesses.
7. Saguaro Store, orders & services
Businesses on Saguaro List can sell products through the Saguaro Store and offer services through their listings. Saguaro List is a venue only: every order, purchase, or service engagement is a transaction directly and solely between you and the business. We are not the seller, we are not a party to the transaction, and we are not responsible for any order placed with — or any service rendered by — a listed business. The selling business is the merchant of record and is solely responsible for its products and services, including fulfillment, shipping, quality, safety, warranties, returns, refunds, cancellations, and applicable taxes. Checkout is processed securely by Stripe on the business's behalf. If you have an issue with an order or service, contact the business directly first; if you cannot reach a resolution, you may report the business to us (see Section 8).
8. Reporting a business
If a business misrepresents itself, fails to deliver an order, or otherwise behaves improperly, you can report it at saguarolist.com/report-business or by emailing support@saguarolist.com. We review reports and may warn, suspend, or remove a business or its listings at our discretion. Reporting a business does not make us a party to your transaction, and we cannot guarantee a refund or any specific outcome, but reports help keep Saguaro List trustworthy for everyone.
9. Acceptable use
You agree not to scrape or bulk-download the Service, submit false or misleading information, impersonate others, infringe intellectual property, or use the Service for any unlawful purpose.
10. Ownership of data & content
The Saguaro List name, logo, design, and the compiled directory and database are owned by us, including all data, listings, and insights generated through the Service (such as aggregated and de-identified data). You retain ownership of original content you submit, but you grant us a perpetual, worldwide, royalty-free, sublicensable license to host, store, use, reproduce, display, adapt, and distribute it to operate, improve, promote, and market the Service and our own products and services. We may retain and continue to use submitted information, subject to our Privacy Policy and applicable law.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Listings, leads, products, and services are provided by independent third-party businesses; we do not endorse, warrant, or guarantee any business, product, or service found through the Service.
12. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or revenue, arising from your use of the Service, including any transaction with a listed business.
13. Changes to these terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.
